versus SMT RITA SINGH & ANR ..... Respondents Through:

% 30.01.2020 1.

The petitioner has filed the present petition, inter alia, impugning an order dated 03.04.2019 passed by the learned Principal Judge, Family Court whereby the petitioner's application for recall of the order dated 21.02.2014, was rejected.

2.

By the said order dated 21.02.2014, the learned Family Court had recorded the petitioner's statement that he was agreeable to pay a sum of ₹8,000/- per month for maintenance to his wife as well as maintenance of their minor daughter from the date of the application (that is, 13.08.2013). 3.

The petitioner and respondent no.1 are present in Court and they state that they have since compromised the matter in terms of the Agreement dated 23.01.2020 arrived at before the Delhi High Court Mediation and Conciliation Centre. In terms of the said settlement, the petitioner agreed to pay a sum of ₹8,00,000/- to the respondent as full and final settlement of her claims. It is agreed that the said amount would be paid in five tranches as

recorded in the said agreement. The said agreement also records that the maintenance as directed by the order dated 21.02.2014, shall be stopped with effect from 01.02.2020. Thus, in terms of the settlement, the liability of the petitioner to pay monthly maintenance as per the order dated 21.02.2014 would be restricted to ₹8,000/- per month from 13.08.2013 to 01.02.2020. In addition, the petitioner would also pay a sum of ₹8,00,000/-, as agreed.

4.

The concerned parties are bound down to the same. 5.

In view of the settlement arrived at between the parties, the present petition is disposed of. The pending application is also disposed of. VIBHU BAKHRU, J JANUARY 30, 2020 RK
