In the meanwhile keeping in view the fact that appellant has withdrawn CS (OS) No.1160/2015 pursuant to the statement made in the instant appeal, we restrain the appellant from prosecuting the interim applications filed in the suit for the prima facie reason that unless liberty is obtained from a Court while withdrawing a suit to continue with the RFA(OS) 15/2016

prosecution of the interim applications once the suit is unconditionally withdrawn interim applications do not survive. 3.
