This appeal is directed against the judgment and order dated 06.02.2023 passed by Mr Ajay Kumar Jain, learned District Judge (Commercial Court-03), South East, Saket, New Delhi in CS (Comm.) 147/2019.

We are informed by the counsel for the parties that they have arrived at a settlement under the aegis of the Delhi High Court Mediation and Conciliation Centre [in short "Centre"].

The Settlement Agreement [SA] dated 26.07.2024 has been placed on record.
4.
Counsel for the appellant says that in terms of the SA, he wishes to withdraw the appeal.

Mr Dhairya Gupta, who appears on behalf of the respondent, says that he would have no objection.

As per the terms of SA, the total claim made by the respondent, i.e., Rs.17,28,913/- has been scaled down to Rs.12 lakhs. 7.
The mode and manner of payment of the said amount have been stipulated in the SA.

We have examined the SA. According to us, the terms of the SA are lawful.
9.
Accordingly, as prayed, the appeal is dismissed as withdrawn. 10.
Parties undertake that they will abide by the terms of the SA. 11.
The Registry will draw a decree in terms of the SA. 12.
Pending applications shall stand closed.
