% 25.02.2016 W.P.(C) 934/2015 and C.M. Appl. No. 7163/2016 Mr. Kulbir Singh states that he is the son of the petitioner. He holds a Special Power of Attorney on behalf of the petitioner, inter alia, authorizing him to appear on behalf of the petitioner in these proceedings. A copy of the Special Power of Attorney has been annexed to this application. Mr. Kulbir Singh submits that the matter has been settled on terms with respondent No.4. The relevant terms of settlement have been set down in a compromise deed dated 15th January, 2016 executed by the parties on 16th January, 2016. A copy of the said compromise deed has also been annexed to the present petition. Apparently, in terms of the same W.P.(C) 934/2015
compromise, a Succession Petition No. 17/2010 was also disposed off by the Court of Sh. Pawan Singh Rajawat, ADJ/CCJ/ARC (South), Saket District Court, Delhi.
Issue notice. Counsel for all the respondents enter appearance and accept notice.
Counsel for respondent No. 4, who is the main contesting respondent, approbates the aforesaid settlement and states that she does not wish to file any reply to the application and also affirms the fact that the aforesaid settlement has been duly arrived at between the parties and is also binding on her clients. She further has no objection to the petition being withdrawn. Counsel for respondent Nos. 1 to 3 also state that they do not wish to file any reply and that they have no objection to the withdrawal of the present matter.
Consequently and as prayed, the application, being C.M. Appl. No.7163/2016 is allowed.
The present petition and C.M. Appl. No.25924/2015 are dismissed as withdrawn in the aforesaid terms.
