% 25.04.2019 Learned counsel for the petitioner has tendered in Court a communication dated 01.04.2019 from the Indian Council of Agricultural Research addressed to the Director, Indian Agricultural Research Institute, whereby the representation of the petitioner has been responded to. This communication reads as follows:
"This is with reference to your Institute's letter No. 6-47/2010P-I dated 23.01.2019 on the subject cited above. The matter has been examined in the Council and I am directed to state that the Council Guidelines dated 25.04.2012 clearly stipulates that "all Senior Scientists appointed on or after 01.01.2009
shall be granted the RGP of Rs.9000/- after assessment by due process as per the provisions of the CAS made effective from 01.01.2009".
Further, in the light of Council's letter No. 1(1)/2009 Per-IV dated 06.11.2018, Dr. Manjeet Singh, who joined the ICAR service in 2010, could be considered for counting of past service if he fulfils the conditions laid down in the Council's circular dated 05.11.2012 regarding counting of past services. It is also clarified that in any case Dr.Manjeet Singh could not be placed in the RGP of Rs. 9000/- without assessment and RGP of Rs. 9000/- could be granted only after assessment by due process as per the provisions of the CAS made effective from 01.01.2009 as clarified in Council's letter dated 25.4.2012."
Learned counsel submits that in case the respondents were to comply with the said response, he would be satisfied. We, therefore, dispose of this petition with the direction to the respondents to implement their decision contained in their communication dated 01.04.2019. The respondents should also take consequential steps for opening the sealed cover for promotion to the post of Principal Scientist, if the occasion arises. The compliance be made within three months.
