% 04.12.2018 C.M. No.32115/2018 (for waiver of fine) 1.

Vide order dated 30th July, 2018, this Court while quashing the FIR and all consequential proceedings, had directed the petitioner to deposit as fine 15% on the settlement amount, i.e., Rs.6,25,000/-. The said fine has admittedly not been deposited till date. On the other hand, the present application has been filed by the petitioner seeking waiver of the fine as imposed by this Court vide its order dated 30th July, 2018.

In my view, the present application seeks modification of the order dated 30th July, 2018 passed by the Court and, therefore, it ought to be listed before the same Bench which had passed the aforesaid order.
