% 04.08.2017 Crl.M.A. 12539/2017 (for extension of time) 1.

This is an application under Section 482 of Cr.PC by which the applicant seeks extension of time for depositing the fine of Rs.10,00,000/-. 2.

By the judgment dated 04.07.2017, the respondent/applicant was sentenced to fine of Rs.10,00,000/- (Ten Lakhs) with direction that she deposits the same with the trial court within a period of thirty days failing which she will be liable to undergo simple imprisonment for a period of six months. The amount of fine, upon being realized, shall be released to the appellant (complainant) as compensation by the trial court. 3.

Learned counsel for the applicant submits that the time to deposit the said amount in the trial court, in terms of the judgment, be extended till 29.08.2017. He further submits that the Special Leave Petition against the said judgment had been filed by the applicant before the Hon'ble Supreme Court. He submits that although the appeal had been filed but the same has

not been listed for hearing. He submits that since the appeal is yet to be heard by the Supreme Court, this court should extend the time to deposit the amount as the time for filing the Special Leave Petition is 90 days but he has been granted the time of 30 days only by this court to deposit the amount in the trial court.

The applicant has already filed the Special Leave Petition against the impugned judgment, this is not at all proper for this court to extend the time to deposit the amount beyond 30 days.

The application is dismissed.
