% 24.01.2017 Aggrieved by the order dated 19.04.2004 passed by the Central Administrative Tribunal by which OA filed by the four respondents was allowed, the petitioners have filed the present petition. The Tribunal had allowed the OA directing that the age of superannuation of the applicants (respondents herein) shall be 60 years.
Notice was issued in this matter. During the pendency of this writ petition, C.M. No.36976/2016 was filed on behalf of respondents No.1 & 2 with a prayer that they are willing to withdraw the OA filed by them and the order of the Tribunal may be set-aside as they are willing to accept their age of retirement as 57 years, provided their pension is released forthwith. Notice was issued in this application.
The pension of respondents No.1 & 2 stands sanctioned and the PPO order has been passed. The pension will be released to respondents No.1 & 2
along with interest as per applicable rate. Resultantly, no further orders are called for qua respondents No.1 & 2. Relevant documents have been supplied to the counsel.
As far as respondents No.3 & 4 are concerned, learned counsel for the parties submit that they have also accepted the age of retirement to be 57 years which is evident from the fact that they are drawing pension. In view thereof, as agreed, the order of the Tribunal is set-aside. The writ petition is accordingly disposed of. G.S.SISTANI, J.
