By virtue of present petition under Article 226 of the Constitution of India, the petitioners seek quashing of the order dated 27.05.2026 passed by the learned Central Administrative Tribunal, Principal Bench, New Delhi (CAT) in O.A. No. 2043 of 2026 entitled 'Dr. Vatsala Aggarwal vs. Govt. of NCT of Delhi & Ors.'

Considering the nature of the impugned order under challenge, learned (Senior) counsels appearing for the parties, without adverting to the merits of the matter involved, submit that it would be in the interest of justice if the same is remanded for fresh adjudication by the learned CAT again, albeit, after re-hearing the arguments of the parties on the aspect of stay.

In view thereof, the present petition is allowed and the impugned order dated 27.05.2026 passed by the learned CAT is set aside. 4.

Resultantly, the proceedings are remanded to the learned CAT for hearing the parties de novo on the aspect of stay on 05.06.2026 after hearing learned counsel for both the parties afresh, and without being influenced by any observations made by this Court herein. 5.

However, considering the factual matrix involved, particularly, since the relief sought by the respondent no.1 before the learned CAT would render infructuous, there shall be a stay on the order dated 21.05.2026, whereby the respondent no.1 was transferred from the post of Director General Health Services, Directorate General Health Services, Government of NCT of Delhi and was placed in "Awaiting Posting" till the aforesaid adjudication.
