Petition under Article 226 of the Constitution of India, 1950 read with Section 482 of the Code of Criminal Procedure, 1973, has been filed on behalf of the Petitioners for quashing the FIR No. 93/2020 under Section 420/34 of the Indian Penal Code, 1860, registered at Police Station Shahdara and the proceedings emanating therefrom.

Essentially, the quashing of the FIR is sought on the ground that it is purely a civil matter arising out of the Agreement to Sell. 3.
Learned counsel for the Respondents, submits that the Charge-Sheet has already been filed in which the Petitioner No. 1, Ms. Payal Sachdeva and Petitioner No. 3, Mr. Sunny Dhawan, have been put in Column No. 12 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. and have not been summoned while cognizance was taken by the learned Metropolitan Magistrate. Only the Petitioner No. 2, Deepak Sachdeva has been summoned.

Submissions heard and the record perused.

Since the Charge-Sheet has already been filed and only the Petitioner No. 2, Deepak Sachdeva has been summoned. Also, because of the matter is listed at the stage of Arguments on Charge, the present Petition is disposed of with liberty to both the parties, to raise their contentions before the learned Trial Court. Pending Application if any, also stands disposed of.
