This suit is filed by the Plaintiff seeking inter alia declaration that the Collaboration Agreement executed between the Defendants in respect of suit property bearing No. 35/2, East Patel Nagar, New Delhi, admeasuring 200 sq. yards is null and void and unenforceable. 2.

Order dated 18.10.2023 passed by the learned Joint Registrar reflects that Defendants No. 4 and 5 were served through publication in newspapers i.e., 'The Statesman' (English Edition) and 'Veer Arjun' (Hindi Edition) on 20.04.2023 but despite service there was no appearance on their behalf. Right to file written statement was closed. Admittedly, no steps have been taken to assail the said order and there has been no appearance on behalf of the said Defendants after the said date. Defendants No. 4 and 5 are accordingly set ex parte.

During the pendency of the suit, Plaintiff and Defendants No. 1 to 3 were referred before the Delhi High Court Mediation and Conciliation Centre, where they have amicable resolved all their disputes and executed a Settlement Agreement dated 30.05.2025. In terms of this Agreement, learned counsels for the Plaintiffs and Defendants jointly submit that as agreed Plaintiff be permitted to withdraw the suit since Defendants No. 1 to 3 have paid an amount of Rs. 1.16 crores in full and final settlement of the claims of the Plaintiff.

In light of the settlement between the parties, the suit is disposed of as withdrawn. As agreed Plaintiff shall not claim any right in the suit property having received a sum of Rs. 1.16 crores in full and final settlement of all her claims.

It is, however, made clear that the settlement between the Plaintiff and Defendants No. 1 to 3 as also this order will not bind Defendants No. 4 and 5.

All pending applications stand disposed of as withdrawn. 7.

Date of 22.08.2025 fixed before the learned Joint Registrar stands cancelled.
