% 27.01.2016 Crl. M.A.No.1484/2016 (for exemption) Exemptions allowed, subject to all just exceptions. Accordingly, the application is allowed.

BAIL APPLN. 201/2016 1.

Vide the present petition, the petitioner seeks transit anticipatory bail to join investigation in case bearing FIR No.7/15/PKD registered at P.S. Vigilance & Anti Corruption Bureau, Palakkad, Kerala, for the offences punishable under Sections 13(1)(d) read with Section 13(2) of the Prevention of Corruption Act, 1988 and Section 409/120-B of the Indian Penal Code, 1860.

Learned counsel appearing on behalf of the petitioner submits that the petitioner earlier received notice dated 10.12.2015 to appear before the aforesaid Authority on 28.12.2015. Since the petitioner was not in India and returned on 21.01.2016, therefore, he could not join the investigation on said date. Thus, the petitioner sought further time to attend the investigation. Accordingly, the said Authority asked him to join the investigation today, i.e., on 27.01.2016.

Learned counsel further submits that the petitioner has apprehension that the aforesaid police may arrest him and then investigate the case further. It is further submitted that the petitioner is not shying away to join the investigation and is ready to surrender before the concerned court. 4.

Keeping in view the averments made in the instant petition and the submissions made by learned counsel for the petitioner and in the interest of justice, I hereby direct the petitioner to surrender before the concerned Court by 02.02.2016.

Till then, no coercive steps shall be taken against the petitioner. 6.

In view of the above, the present petition is disposed of. 7.

A copy of this order be given dasti to the learned counsel for the parties under the signature of the Court Master. SURESH KAIT, J.
