The present petition under Article 226 of the Constitution of India seeks the following prayers:

"A. Issue a Writ of Certiorari or any other appropriate Writ, Order or Direction, quashing and setting aside the Notice for Eviction/Vacation of Attached Property dated 27.05.2026, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

bearing F.No. ECIR/06/PMLA/LKZO/2019/AD(PS), issued by Respondent No. 2 under Section 8(4) of the Prevention of Money Laundering Act, 2002, and handed over to the Petitioners on the late evening of 28.05.2026; B. Direct that no coercive action for dispossession or vacation of the Petitioners from the property at Khasra No. 343 & 345 of 228, Village Saidulajab, Tehsil Mehrauli, Delhi be taken by the Respondents during the pendency of the pending Appeal and this Writ Petition;

C. Pass such other and further orders as this Hon'ble Court may deem fit and proper in the facts and circumstances of the present case, including costs."

Learned counsel for the petitioner submits that by way of impugned eviction notice dated 27.05.2026, the petitioners have been directed to vacate the subject premises. The said notice is reproduced as under: - The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Learned counsel for the petitioner submits that the proceedings were listed before the learned Appellate Tribunal and vide orders dated 24.04.2026 and 13.05.2026, the respondents were directed to give certain information regarding the case of the petitioner.

Learned counsel for the respondents, on advance notice, submits that The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

the said eviction notice had been passed in pursuance of an order dated 12.02.2026 passed by the Hon'ble Supreme Court in W.P.(Civil) No. 940/2017 titled as Bikram Chatterji & Ors. v. Union of India & Ors., whereby the following directions were passed: "That being said, as the aforestated status report of the DoE also states to the effect that the DoE is willing to undertake sale of attached assets, be it at Indore or elsewhere, if ordered to do so and has also cited a precedent in that regard, viz. the order dated 10.10.2025 passed in M.A. No. 2227/2024 in W.P. (Crl.) No. 31/2020, titled "Nowhera Shaik & Anr. vs. Union of India & ors.", we deem it appropriate to direct the DoE to undertake the sale of the attached properties, details of which have been furnished in Table-1 at pages 7 and 8 of the aforestated status report, in accordance with law and due procedure."

Learned counsel for the respondents submits that these subject properties mentioned at Column no. 4 of the table no. 1 of the status report, are referred to in the aforesaid order passed by the Hon'ble Supreme Court. 8.

Learned counsel for the respondent submits that the aforesaid status report was given to the Hon'ble Supreme Court in a sealed cover; however, he has shown the relevant portion of the same to this Court. 9.

This Court has perused the said status report. The subject properties are indeed part of the said table being mentioned at Column no. 4. 10.

In view of the above, learned counsel for the petitioner seeks leave of this Court to withdraw the present petition, with liberty to approach the Hon'ble Supreme Court for necessary orders.
