% 30.05.2019 Petitioner seeks pre-arrest bail in FIR No.114/2019, under Sections 377/376/506/34 of IPC, registered at police station Mahendra Park, Delhi while claiming parity with co-accused-Chinky, who has been granted interim protection in this FIR case.

Upon hearing, I find the allegations levelled against petitioner are of rape. Petitioner has been in custody earlier also for the offence of rape. Although, it was stated during the course of hearing that petitioner has been acquitted in the earlier rape case, but no document in this regard has been placed on record. It is relevant to note that there are no allegations of rape against co-accused-Chinky and therefore, petitioner's case is not at par with that of co-accused-Chinky.

In the facts and circumstances of this case, I do not find it to be a BAIL APPLN. 1410/2019

fit case for extending a concession of pre-arrest bail to petitioner. Accordingly, both the applications are disposed of, without commenting upon the merits of this case.
