The petitioner has filed the present petition, inter alia, praying that directions be issued to respondents to provide the petitioner access to his medical records.

Given the limited nature of relief sought, this Court does not consider it apposite to issue notice and await representation on behalf of the respondents.

The petitioner claims that he was admitted as an in-patient at Vidyasagar Institute of Mental Health and Neuro Sciences (VIMHANS) on 21.02.2015 and remained at the said institution till his discharge on 10.03.2015. The petitioner claims that he pursued with his medical treatment at VIMHANS as an out-patient thereafter.

The petitioner claims that on 14.05.2018 he requested for his relevant

medical records and was orally informed that the same would be provided to him only after he had obtained an order from a court or a competent authority.

The petitioner claims to have served a notice dated 13.07.2018 on the respondent, once again seeking certified copies of the medical records including consent forms, daily mental status evaluations, prescription chart and other documents. Thereafter, the petitioner also filed an application dated 29.09.2018 under the Right to Information Act, 2005. However, the petitioner has not been provided his medical records. 6.

Plainly, the petitioner is entitled to copies of his medical records. Accordingly, respondent no.1 is directed to provide the petitioner a copy of all his medical records as available with it, within a period of six weeks from today.

The petition is allowed in the aforesaid terms. 8.

The pending application is disposed of.
