% 22.07.2016 Counsel for the petitioner submits that the matter is pending before the Court below since 2011 and the interim maintenance was granted on 07.11.2012 but the Court below is not proceeding. It is further submitted that as per the judgment in the case of Kusum Sharma vs Mahinder Kumar Sharma 2014 (214) DLT 493 final determination of maintenance could only be done after having the statements of both the sides on the proforma and the petition may be disposed of by giving direction to the Court below. In the facts and circumstances, the Court below is directed to dispose of the maintenance petition preferably within a period of six months.
