The present petition is filed seeking quashing of the summoning order dated 11.10.2006 passed by the learned Additional Chief Metropolitan Magistrate, Karkardooma Courts, Shahdara, Delhi.

The complaint in the present case was filed by Respondent No. 2 against the petitioner's brother on which the Court, after examining the complaint, had issued summons against the petitioner as well for offence under Section 471 read with Section 120B of the Indian Penal Code, 1860.

An affidavit has been filed on behalf of Respondent No. 2 deposing that the subject complaint was given due to the matrimonial and family disputes which existed between the parties at that time.

The complainant has deposed that, subsequently, she had also obtained divorce from the petitioner's brother and is now happily residing with her son and has no grievance, ill will or grudge against the petitioner and she does not wish to pursuing any proceedings.

Respondent No. 2 is duly represented by Mr. Dharmendra Singh, learned Advocate.

Considering the affidavit of Respondent No. 2, in the opinion of this Court, no purpose would be served by continuing with the proceedings once the complainant is satisfied and has no grudge against the petitioner. The dispute seems to have arisen out of the matrimonial acrimony that the complainant had with the petitioner's brother from whom she has already taken divorce.

In view of the above, the present petition is allowed. The impugned summoning order dated 11.10.2006 is set aside. AMIT MAHAJAN, J NOVEMBER 20, 2025 "SS"
