The present application is filed under Section 438 of the Code of Criminal Procedure, 1973 (CrPC) read with Section 482 of the CrPC, seeking pre-arrest bail in FIR No. 582/2023 dated 23.08.2023, registered at Police Station Tilak Nagar, for offences under Sections 420/120-B/34 of the Indian Penal Code, 1860 (IPC).

The learned counsel for the applicant submits that a pure money transaction has been given a criminal colour. The applicant has already returned some amount to the complainant. 3.

The learned Additional Public Prosecutor for the State submits that the applicant has been declared a proclaimed person under Section 82 of the CrPC by order dated 08.04.2024 passed by the learned Trial Court.

He submits that in such circumstances, the present bail application is not maintainable.

Considering the above, the learned counsel for the applicant seeks liberty to withdraw the present bail application and take appropriate steps for cancellation of proceedings under Section 82 of the CrPC.

In view of the above, the present bail application is dismissed as withdrawn with the aforesaid liberty. Pending application(s) also stand disposed of.
