Mr. Jay Savla, Senior Counsel for the Petitioner, on instructions states that subsequent to the directions issued by this Court, the Respondents have paid the Terminal Excise Duty amounting to INR 24 crores approximately. Mr. Savla further submits that the Petitioner is also entitled to interest at the rate of 6 % per annum in terms of Clause 8.5.1 of Chapter 8 of the Foreign Trade Policy 2009-2014.

In the opinion of the Court, since the excise duty has been refunded, the present petition can be disposed of with the following directions: 2.1.
The Petitioner shall make a representation to the Respondents for the claim of interest within a period of two weeks from today. 2.2.
This representation shall be considered and decided in accordance with law by the Respondents within a period of four weeks thereafter. All rights and contentions of the parties are left open. 2.4.
In the event if the decision is rendered against the Petitioner, they shall be free to pursue the legal remedies in accordance with law. 3.
