O R D E R

% 03.03.2016 In view of the orders passed by this Court in the connected petition C.M. (M) No.740/2015, the present petition filed by Sukhdev Raj Arora is not really pressed. By the impugned order dated 19.11.2015, the application filed by Sukhdev Raj Arora under Section 151 of the CPC seeking a stay of the proceedings under Section 14 (1)(b) of the DRCA had been dismissed. The contention of Sukhdev Raj Arora was that in view of the suit for specific performance having been filed by the company M/s Yorco Sales Pvt. Ltd. against M.K. Bhargava, these proceedings be stayed did not find favour with the Trial Court.

Sukhdev Raj Arora is in appeal before this Court. In the connected petition C.M. (M) No.740/2015, this Court has already held that the pendency of the suit for specific performance which is a

suit between the company and M.K. Bhargava can have no bearing upon the eviction proceedings which are against the two individuals i.e. against Sukhdev Raj Arora and M.K. Bhargava where the company is admittedly not a party.

Accordingly, there i no merit in this petition. Dismissed. INDERMEET KAUR, J MARCH 03, 2016
