Learned counsel for the petitioner seeks leave to withdraw the present petition. He, however, prays that since the respondent is not participating in the trial, the same be directed to be expedited. 2.

Leave, as prayed for, is granted. The petition is dismissed as withdrawn alongwith the pending application with direction that the trial court shall take into account the mature age of the parties and make an endeavour to expedite the trial. However, it is clarified that in case at the time of disposal of the maintenance petition, the Trial Court comes to the conclusion that the respondents are entitled for lesser or higher maintenance, the Trial Court would be at liberty to grant adjustment of the arrears either way.
