This application is wrongly titled under Order XXIII Rule 3 CPC because actually this application will be under Order XXIII Rule 1 CPC to be taken with the fact that apology tendered on behalf of the defendants is accepted by the plaintiffs and only therefore plaintiffs are not pursuing the suit.

Since therefore the defendants have apologized to the plaintiffs and plaintiffs have accepted their apology, accordingly the suit is not pressed for the said reason.

Suit accordingly stands disposed of.
