By way of the present petition, the petitioner seeks quashing of FIR bearing no. 268/2024, dated 11.10.2024, registered at Police Station Delhi Cantt, Delhi, for the offences punishable under Sections 289/125(a)/3(5) of the Bharatiya Nyaya Sanhita, 2023 (hereafter 'BNS'). 4.
The petitioner and respondent no. 2 are present before this Court. They have been identified by their counsel and concerned Investigating Officer (IO) from Police Station Delhi Cantt., Delhi. Briefly stated, facts of the present case are that on 01.10.2024, a JCB machine was operating at a construction site at Mehram Nagar Red Light, Delhi Cantt, where the petitioner was posted as a Supervisor, when an iron rod had come hurdling towards respondent no.2 and had collided with him, striking him on his left side, resulting in a blunt impact and causing him to bleed. Based on the aforesaid event, the present FIR was registered on the 11.10.2024 against the petitioner under the relevant sections. 6.
It is stated that both the parties have amicably settled the present matter vide settlement agreement dated 20.03.2025, entered between them. The petitioner has handed over a Demand Draft bearing no. 000113, in the sum of Rs.4,50,000/-, drawn on Bank of India, towards the entire medical treatment provided to respondent no. 2.

On a query made by this Court, respondent no.2, who has been identified by the concerned IO, has categorically stated that he has entered into compromise out of his own free will and without any pressure, coercion or threat. Respondent no. 2 further states that he has no objection if the present FIR is quashed.

In view of the above fact that the parties have amicably resolved their differences of their own free will, without any coercion and no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 9.
