1. The present petition under Section 11 of the Arbitration and Conciliation Act, 1996 seeks appointment of an Arbitrator. Learned counsel for the Respondents on instructions, states that they have no objection to the prayer made in the application, however he submits that the appointment be made from the panel of the Arbitrators of Public Works Department, Government of NCT. A list of Panel Arbitrator has been handed over to the Petitioner and the copy thereof has been taken on record. Learned counsel for the Petitioner on instructions states that he has no objection to the appointment Mr. R.J. Bakhru, as an Arbitrator, whose name finds mention in the said list.

2. Accordingly, the petition is allowed and Mr. R.J. Bakhru is appointed as an Arbitrator to decide the disputes and differences including claims and

counter claims that are arising out of the agreement between the parties.

3. The parties are directed to appear before the Arbitrator as and when notified. Learned Arbitrator will issue a declaration under Section 12 read with the attendant provisions of the 1996 Act before entering upon reference.

4. The Petition is allowed in the above terms. No order as to costs. The Registry will despatch a copy of this order to the learned Arbitrator. SANJEEV NARULA, J AUGUST 09, 2019 nk
