The present petition under Section 482 of the CrPC read with Article 227 of the Constitution of India seeks the following prayers:- "(i) Set aside the Orders dated.04.January 2019 in Case FIR No. 1001/2015 registered at Police Station KN Katju Marg (Outer), under Sections 420, 468, 471, 506, and 34 of Indian Penal Code, 1860, declaring the Petitioner I Accused as . a Proclaimed Offender, along with subsequent proceedings of being declared as a Proclaimed Offender;"
a. Pass any other or further order(s) as this Hon'ble court may deem fit and proper in the facts and circumstances of the case." 3.
Vide order dated 05.12.2023, this Court recorded as under;- "2.
Learned counsel appearing on behalf of the petitioner submits that the subject matter of the present FIR has been settled with the complainant before Delhi Mediation Centre, Rohini District Courts, Delhi vide settlement/agreement dated 25.08.2023. 3.

Learned APP for the State submits that the subject matter of the present FIR, i.e., the property in dispute has been mortgaged by the present petitioner and her husband with some banks and investigation is still ongoing in that regard. It is submitted that the applicant needs to join the investigation.

Learned counsel for the petitioner submits that the latter is residing at Village Kachir, P.S. Kakarwai, Tehsil Garautha, District Jhanshi, Uttar Pradesh and her contact number is 7078800167 and that of her husband is 9310387078.

On the petitioner joining the investigation as and when directed by the Investigating Officer, no coercive steps shall be taken against her till the next date of hearing." 4.
It is pointed out by the learned counsel appearing on behalf of the petitioner that the chargesheet and supplementary chargesheet stands filed with respect to the present FIR before the Court of competent jurisdiction. However, the petitioner has not been summoned on account of the impugned order. It is however submitted that the petitioner's husband has been appearing. The said fact is confirmed by the Investigating Officer as well as the learned counsel appearing on behalf of the complainant. 5.
Learned counsel appearing on behalf of the complainant (Sushila Verma) submits that the matter has been compromised and the parties will be taking necessary steps for seeking the quashing of the present FIR. 6.
Investigating Officer, PSI, Bharat is present in Court today and confirms the fact that the chargesheet and the supplementary chargesheet have been filed before the learned Trial Court.

In view of the fact that the chargesheet and the supplementary chargesheet have been filed and the investigation is complete, the order dated 04.01.2019 is hereby set aside.
