Writ Petition under Articles 226/227 of Constitution of India has been filed on behalf of the Petitioner to state that an Appeal under Section 9 of the Public Premises (Eviction of Unauthorized Occupants) Act has been filed before the learned District and Sessions Judge along with an Application for stay, which has not been heard.

A prayer is made that an ad interim stay of eviction order dated 20.05.2026 be granted and the Respondent be restrained from acting on the said Eviction Order and also to stay the operation of Eviction Order dated 20.05.2026.

On advance Notice, learned Counsel for the Respondent has appeared and accepted the Notice.

The main grievance of the Petitioner is that despite the stay Application having been filed with the Appeal under Section 9 of the Public Premises (Eviction of Unauthorized Occupants) Act, the same has not been taken up or heard by the learned District and Sessions Judge. 5.
Learned Counsel for the Respondent states that no execution till date has been instituted in respect of Eviction Order dated 20.05.2026. 6.
Learned District and Sessions Judge is hereby, directed to decide the stay Application filed along with the Appeal under Section 9 of the Public Premises (Eviction of Unauthorized Occupants) Act, forthwith. 7.
The matter be put up before the learned District and Sessions Judge, Patiala House Courts on 10.06.2026.

The parties are directed to appear before the learned District and Sessions Judge on the said date.

No execution has been filed and there is no imminent execution of the eviction order dated 20.05.2026 contemplated till Friday, as submitted by the learned Counsel for the Respondent.

The Writ Petition along with pending Applications, stands disposed of accordingly.
