When confronted with the order dated 07.04.1989, passed by this Court in Suit No.492/1989, titled Vijay Dewan v. Shri Gobind Sahai & Ors, Mr. Bharat Arora, learned counsel, who appears for the plaintiff, explains various circumstances, and submits that on account of some inadvertence and communication gap, necessary averments could not be made. 2.

He, however, seeks liberty to withdraw the instant civil suit, with liberty to re-institute the same. He also prays that since the suit is at its initial stage, therefore, the necessary set off/Court fees may be granted. 3.

Therefore, the present civil suit is dismissed as withdrawn, along with pending applications, with liberty as prayed for. 4.

The registry is directed to grant the benefit of set-off of the Court fees paid in the instant civil suit, should the plaintiff seek to re-institute.
