+ CM(M) 243/2011 and CM No. 4473/2011 DELHI TRANSPORT CORPORATION & ANR..... Petitioners Through Mr. U.N.Tiwari and Mr. Sunil Kr.

Ojha, Advocates.

versus RAJPAL SINGH ..... Respondent Through Mohd. Parvez Dabez, Advocate.

CORAM:

HON'BLE MR. JUSTICE JAYANT NATH

O R D E R

% 06.01.2017 Learned counsel for the respondent, at the outset, very fairly submits that the respondent has received a sum of Rs.44,494/- which was wrongly deducted by the petitioners despite passing of an injunction order. He submits that though some other amounts are payable by the petitioners, however, without prejudice to his rights and contentions to claim the said amount, he has no objection if the present petition is disposed of with a direction to the petitioners to pay some costs to the respondent. In view of the above, subject to payment of costs of Rs. 10,000/- to the respondent, the impugned orders dated 13.12.2010 and 29.09.2009 of the trial court are set aside.

The petition stands disposed of.

All pending applications also stand disposed of. JAYANT NATH, J.
