The present is an application on behalf of M/s Indraesh Developers (P) Ltd. for impleadment in the present matter, being owner of the property in question, i.e., Premises bearing No. 64-64A, 2nd floor, Regal Building (East), Connought Place, New Delhi-110001.

Considering the submissions made before this Court, M/s Indraesh Developers (P) Ltd. is impleaded as respondent no. 3 in the present writ petition.

The amended Memo of Parties filed along with the present application, is taken on record.

The present application has been filed on behalf the petitioners under Order XXIII Rule 1 of the Code of Civil Procedure, 1908 ("CPC") seeking withdrawal of the present writ petition.

It is submitted that multiple proceedings for eviction have been initiated by the respondent no. 3, i.e., M/s Indraesh Developers (P) Ltd. against the petitioner with respect to the subject property. Thus, with an intent to bring up quietus to all the issues/disputes between the petitioner and M/s Indraesh Developers (P) Ltd., the parties have amicably resolved the differences/disputes and have entered into an agreement and executed a Settlement Deed 23rd November, 2025.

It is submitted that as per the terms of the Settlement Deed dated 23rd November, 2025, the possession of the subject property has already been handed over by the petitioner to M/s Indraesh Developers (P) Ltd. on 26th November, 2025. Thus, the present application has been filed. 8.

Considering the submissions made before this Court, the petitioner is allowed to withdraw the present writ petition. 9.

Accordingly, the present writ petition, along with pending applications, is dismissed, as withdrawn.
