This petition is preferred on behalf of the Petitioner under Section 29A (4) of the Arbitration and Conciliation Act, 1996 ('1996 Act') seeking extension of the mandate of the Arbitral Tribunal. 4.

Disputes between the parties arose in relation to a Memorandum of Understanding dated 15.09.2020 executed between the parties pertaining to a Tender under a consortium for supply of Oxygen Generation Plants at Jammu. Petitioner filed ARB.P. 571/2021 under Section 11(6) of 1996 Act for appointment of an Arbitrator, which was allowed vide order dated 17.05.2022 and a Sole Arbitrator was appointed. this Court extended the mandate of the learned Arbitrator in O.M.P.(MISC.)(COMM.) 747/2024 as the same had expired on 13.07.2024. It is stated in the petition that evidence stands concluded and the proceedings are at the stage of final arguments and thus, the mandate be extended.

Issue notice.

Mr. Ayush Puri, learned counsel for the Respondent accepts notice and, on instructions, submits that the Respondent has no objection to the extension of mandate of the learned Arbitrator by period of 06 months. 7.

Accordingly, with the consent of the parties and considering that the arbitral proceedings are at the stage of final arguments, mandate of the Arbitral Tribunal is extended by a period of 06 months from 02.05.2025 and period from 23.03.2025 to 01.05.2025 is regularized. 8.

Petition is allowed and disposed of in the aforesaid terms.
