Mr. Suri, learned counsel appearing for the petitioner submits that since the respondent is a scheduled institution under the provisions of Section 14(2) of the Administrative Tribunal Act, 1995, he would file the present petition before the Central Administrative Tribunal, Principal Bench, New Delhi, within two weeks from today. In view of the above, the petitioner is permitted to withdraw the present writ petition and file the same before the aforesaid Tribunal within two weeks from today.

The Tribunal is requested to take up the matter at the earliest, keeping in view the peculiar facts that the petitioner before this Court is a widow aged almost 87 years and seeks enhancement of family pension, in accordance with the rules.

In view of the above, the present petition is dismissed as withdrawn with the liberty as sought granted.
