Learned counsel for the Plaintiff submits that owing to certain technical defects in the present suit, the Plaintiff does not wish to pursue the same and seeks permission to withdraw the suit with liberty to file afresh. 4.
Learned counsel appearing for Defendant No. 2 submits that he has no objection in case the present petition is permitted to be withdrawn simpliciter. 5.
In view of the submissions made, the present suit is dismissed as withdrawn, with liberty to the Plaintiff to file afresh, in accordance with law. Pending applications, if any, also stand disposed of. 6.
