Petition under Section 528 of BNSS has been filed on behalf of the Petitioner for setting aside Order dated 03.06.2026 passed by learned Sessions Court, Delhi, whereby Non-Bailable Warrants have been issued against the Petitioner in FIR No.0026/2026 and Application filed by the Petitioner seeking cancelation / recall of Non-Bailable Warrants has been dismissed.

Learned Senior Advocate for the Petitioner submits that Notice had been served upon the Petitioner, has been duly replied by his wife. It is submitted that Petitioner was out of town and was unwell and had sought time. However, Non-Bailable Warrants got issued against him, only for the purpose of securing his presence to join investigations. 3.

Petitioner is willing to appear before the Investigating Officer on 13.06.2026 at 11:00 AM to join the investigations. Learned APP for the State appears on advance Notice, accepts Notice and submits that Petitioner's remedy does not lie by way of cancellation of Non-Bailable Warrants. The Proceedings under Sections 82 and 84 have also been initiated and only remedy available to the Petitioner is to seek Bail, in accordance with law.

Submissions heard and record perused.

As has been submitted by learned Senior Advocate for the Petitioner that Non-Bailable Warrants were issued only for the purpose of ensuring that Petitioner joins investigations. He further submits that Petitioner shall join the investigations immediately on 13.06.2026 at 11:00 AM. 6.

Investigating Officer is at liberty to investigate and interrogate the Petitioner and proceed further in accordance with law, including arrest, if grounds for arrest are made out.

With the aforesaid observations, present Petition along with pending Applications is disposed of.
