O R D E R

The present application is filed under Section 439 of the Code of Criminal Procedure, 1973 seeking grant of interim bail in FIR No.677/2021 dated 14.11.2021, for offence under Section 307 of the Indian Penal Code, 1860, registered at Police Station Sadar Bazar, on the ground that the mother of the applicant has to undergo major surgery and there is no one in the house to take care of his mother.

The learned Trial Court had dismissed the application filed by the applicant seeking interim bail noting that the mother of the applicant is not alone and sister of the applicant is available to take care of his mother. It also noted that the tentative date of hysteroscopy surgery is given.

The fact of surgery has been verified by the State. It is not denied that the surgery is now fixed for 24.05.2024. It is also pointed out by learned counsel for the applicant that the girl who is staying in the house is not the applicant's sister. He has produced the Aadhar Card of the said girl whose father is stated to be one person, namely, Nasir Khan. 5.

Considering the above, the applicant is directed to be released on bail for a period of seven days from 21.05.2024 till 27.05.2024 on furnishing a personal bond for a sum of ₹50,000/- with two sureties of the like amount, one of whom shall not be in blood relation of the applicant, subject to the satisfaction of the learned Trial Court, on following conditions: a.

The applicant shall provide the address where he would be residing after his release and shall not change the address without informing the concerned IO/ SHO;

b.

The applicant shall, upon his release, give his mobile number to the concerned IO/SHO and shall keep his mobile phone switched on at all times;

c.

The applicant shall, upon his release, speak with the concerned IO once every day;

d.

The applicant shall under no circumstance leave the boundaries of NCT of Delhi during his release; e.

The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case or tamper with the evidence of the case, in any manner whatsoever.

The applicant is directed to surrender on or before 28.05.2024, before the concerned Jail Superintendent. 7.
