O R D E R

The present petition has been filed under Section 439 CrPC seeking interim bail in connection with the FIR No.347/2022 under Section 302 IPC and Sections 25/27 of Arms Act (subsequently, charge sheet was filed under Sections 302/420/511/467/468/471/482/201/120B/34 IPC and Sections 25/27 of Arms Act) registered at Police Station Jamia Nagar on the ground that the petitioner is a heart patient and needs urgent medical attention. 2.
Notice was issued in the present petition on 08.05.2024 with a direction to the Jail Superintendent to furnish a medical Status Report of the petitioner. The medical status report dated 17.05.2024 has been received from the Jail Superintendent and the same is on record. 3.

A perusal of the said medical report shows that the petitioner is a cardiac patient and is in need of emergency care. The relevant part of the Status Report reads as under:- "At present, inmate patient is a follow up case of Chronic LBA with Radiculopathy, CAD/ Old IWMI/ (TNK+) / EF 45-50%. He came to CJ-8/9 dispensary emergency multiple times for his complaints of Atypical Chest Pain on & off with Dyspnoea (because of EF 45- 50%) and as being inmate is Cardiac Patient he needs emergency care. The MRI DL Spine with screening of whole spine & MRI right shoulder of the inmate patient is yet to be conducted. All the prescribed medications is being provided to him from Jail Dispensary, CJ - 8&9." 5.
In view of the above, the petitioner is entitled to interim bail for a period of 45 days from the date of his release. Accordingly, the petitioner is enlarged on interim bail subject to his furnishing a Personal Bond in the sum of Rs. 25,000/- and one Surety Bond of the like amount to the satisfaction of the Trial Court/CMM/Duty Magistrate, further subject to the following conditions:- a) Petitioner shall appear before the Court as and when the matter is taken up for hearing.
b) Petitioner shall provide mobile number to the IO concerned which shall be kept in working condition at all times and he shall not change the mobile number without prior intimation to the Investigating Officer concerned.
c) Petitioner shall not indulge in any criminal activity and shall not communicate with or come in contact with the witnesses. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
d) Petitioner shall keep the IO updated on weekly basis as regards the treatment he has received and in support of such updation shall also furnish necessary medical record.

Upon expiry of period of 45 days as stated above, the petitioner shall surrender before the Jail Superintendent.

The petition stands disposed of.

Copy of the order be forwarded to the concerned Jail Superintendent for necessary compliance and information.
