% 29.01.2016 Crl.M.A. No.1636/2016 (for exemption) Exemptions allowed, subject to all just exceptions. Accordingly, the application is allowed.

BAIL APPLN. 228/2016 1.

Keeping in view the averments made in the instant petition and after hearing the counsel for both the parties, I hereby set aside the order dated 21.01.2016 passed by the learned Additional Sessions Judge, Delhi. 2.

As admitted, the maintenance amount has already been deposited in favour of the complainant, therefore, the issue of deposition of Rs.5,000/- does not remain.

As regards the issue of payment of medical bills, i.e., around Rs.15,000/- is concerned, the petitioner is directed to pay the same by way of pay order or cash in favour of the respondent No.2. In turn, the complainant is also directed to hand over the original medical bills to the petitioner enabling him to pay the same within three days. 4.

I hereby make it clear that the petitioner shall hand over the medical card of Maharaja Agrasen Hospital, Punjabi Bagh, New Delhi, to the complainant facilitating her to avail medical facilities in future within ten days from today.

Considering the apprehension of the complainant that the petitioner may influence her treatment, being working in the aforesaid Hospital, though I am not satisfied, but if any treatment is required, the complainant will be at liberty to go to any Branch of the Maharaja Agrasen Hospital in Delhi.

It is also directed that handing over of the medical bills by the complainant, payment of the medical bills by the petitioner and handing over the medical card to the complainant shall be taken place through the Investigating Officer.

In view of the above, the present petition stands disposed of. Crl.M.A. No.1635/2016 (for stay) With the disposal of the petition itself, the present application has become infructuous. The same is dismissed accordingly. A copy of this order be given dasti to the learned counsel for the parties.
