This petition has been filed with the following prayers:- "a. To issue the refund due to the Petitioner. b. To grant compensation in the form of interest, Litigation expenses and other administrative costs or otherwise for the financial loss suffered on account of illegal adjustment in favour of third parties resulting in withholding the refund for unreasonable period."

The learned counsel for the petitioner fairly states that an amounts of Rs. 5,07,973/- and Rs. 3,15,626/- have been refunded to the petitioner but the interest thereon has not been granted.

If that be so, we dispose of the writ petition by directing the respondent/Assessing Officer to decide the aspect of interest on the aforesaid amount and convey the decision to the petitioner. If any amount is payable, the same shall be paid within four weeks thereafter. 4.

If the petitioner is aggrieved by any order to be passed by the respondent on the interest aspect, liberty shall be with the petitioner to seek such remedy as available in law.
