Arguments on the application for summary judgment (I.A.
36685/2024) were heard on 15th July, 2025.

After hearing, the counsel for the defendants was asked to take instructions.

Mr. Junaid Alam, counsel appearing on behalf the defendants has returned with instructions and submits as under: i.
Defendants have stopped the use of the impugned trademark 'G-VER' and 'G-VAR' and has no intention to use the said marks in the future.
ii.
Defendants are willing to pay a sum of Rs.5,00,000/- to the plaintiff towards damages and costs.

Counsel for the plaintiff is satisfied with the aforesaid statement. 5.

the plaintiff and against the defendants in terms of prayer clauses 31 (a) and 31 (b) of the plaint. Further, in satisfaction of prayer clauses 31 (d) and 31 (e), the defendants shall pay a sum of Rs.5,00,000/- to the plaintiff within two (2) months from today. In the event the aforesaid amount is not paid by the defendants within two (2) months, the defendants shall be liable to pay interest on the aforesaid amount @9% per annum thereon. 6.
Let the decree sheet be drawn up.

In view of the settlement arrived at between the parties, the Registry is directed to issue a certificate of refund of 100% of the Court Fees in favour of the plaintiff, in terms of Section 16 of the Court Fees Act, 1870.
