This is a Contempt Petition on behalf of the Petitioner under Sections 10, 11 and 12 of the Contempt of Courts Act, 1971 read with Article 215 of the Constitution of India, 1950 for initiating contempt proceedings against the Contemnors for wilful and deliberate disobedience of the orders of the Division Bench of this Court in judgment dated 30.01.2026 passed in W.P.(C) No. 1905/2025 ("Judgment"). Vide Judgment, the Hon'ble Division Bench of this Court has passed for the following directions: "14. In the facts of this case, we direct one post in NDA 156 Course under the category Air Force (GD) (male) be kept vacant till the medical examination of the petitioner is carried out on· 06.03.2026 or immediately thereafter and if the petitioner is found medically fit, he shall be accommodated in the NDA 156 Course." 2.

Learned Counsel for the Petitioner has submitted that despite the clear direction as contained in Paragraph No. 14 of the Judgment the Contemnors / Respondents have issued a letter dated 09.06.2026 stating as under: The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. "4. While you have been found medically fit tor Air force (GO) (male), however, on merit, you have secured position 411 whereas the vacancies for Air Force (GD) (male) have been exhausted upto marit position 345. Accordingly, on merit, you do not qualify for selection to Air Force (GD)(male)."

Issue Notice. The learned Counsel for the Respondents accepts Notice.

After arguing at some length, learned Counsel for the Respondents makes a statement that the Respondents shall seek modification / clarification of the Judgment and subject to the orders passed by the Hon'ble Division Bench, learned Counsel for the Respondents, on instructions, states that the Petitioner shall be given the post of Airforce (GD) (male) forthwith. 5.

The above statement is taken on the record and the Respondents are directed to be bound by the said statement. In view of the above statement, no further orders are required to be passed in this Petition. Accordingly, the Petition is disposed of in the aforesaid direction. 6.

It is clarified that in case the clarification of the Judgment is against the Petitioner, the Petitioner shall be accommodated in the Army as his second preference as offered in letter dated 09.06.2026, which the Petitioner has accepted.
