This application is, accordingly, disposed of. W.P.(C) 6551/2019 Vide the present petition, the petitioner seeks direction as under: i. The respondents for granting voluntary retirement on the basis of notice dated 01.10.2018;

ii. To release the retiral benefits due after granting the voluntary retirement effective from the completion of 90 days notice period from 01.10.2018 along with all consequential benefits and arrears; iii. To grant interest @ 24% on the dues of the retiral benefits; iv. To withdraw the reply to legal notice dated 10.05.2019.

For the aforesaid purpose, the petitioner has made representation and sent legal notice and to the legal notice, the Ministry has filed reply dated 10.05.2019.

The fact remains that the petitioner is seeking voluntary retirement as per Statute 28(a), 15 (c) (v) and it is not in dispute that there is no disciplinary proceedings pending against the petitioner as on date. In view of the submission made in the said petition and submission of counsel for the petitioner, I hereby dispose of the present petition directing the respondent no.1 to take final decision on the representation on the voluntary retirement filed by the petitioner within six weeks from the receipt of this order.

The decision taken shall be communicated to the petitioner within one week thereafter.
