The present petition has been filed by the petitioners seeking that the respondent/MCD be restrained from taking any punitive action against the construction raised at Shop No.16, Block-B on Second, Third and Fourth Floor, New Subzi Mandi, Azadpur, Delhi.

Learned counsel for the MCD, who appears on advance notice, submits that no demolition order has been passed as yet with regard to the property in question.

As such, he submits that the present petition is pre-mature. He submits that even if a demolition order is passed, the same shall be subject to the petitioner's appellate remedies.

Be that as it may, after some hearing, respective counsel for the parties are in agreement that the present petition shall be treated by the MCD as a representation and a speaking order shall be passed thereon, after affording an opportunity of hearing to the petitioner.
