Present writ petition has been filed by the Petitioner challenging the order dated 05th February, 2024 passed by the DRT-II, New Delhi whereby the application filed by the Petitioner seeking condonation of delay in filing the Misc. Application was dismissed.

This Court is of the view that the Petitioner has an alternative effective remedy by filing an appeal before the Debt Recovery Appellate Tribunal.

Consequently, the present appeal is dismissed with liberty to the Petitioner to file appropriate proceedings in accordance with law. Pending applications are disposed of. The rights and contentions of all the parties are left open.
