The present writ petition has been filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking the following prayers:

"a) Issue a writ in the nature of Mandamus granting parole for a period of sixty (60) days to the petitioner in FIR No. 165/2011, U/S 302/34 IPC, P.S. Vasant Vihar;

b) Pass such further order(s) as this Hon 'ble Court deems fit and proper."

In the facts and circumstances of the case, considering that the Applicant has undergone incarceration for more than fourteen years and that his real sister expired on 09.06.2026 and her tehrvi is scheduled for 21.06.2026, this Court is inclined to grant parole to the Applicant. 5.

Accordingly, the Applicant is granted parole for a period of four weeks, subject to the following conditions:

I.

That he shall furnish cash surety of Rs.10,000/- along with a personal bond in the like amount for his release on parole to the satisfaction of the Superintendent, Central Jail No.2. II.

That he shall maintain peace and good behaviour during his period of release on parole.

III.

That he will remain at his residence or shall visit the residence of his sister on the date of her tehrvi during the period of his release on parole and his ordinary place of residence shall be: - R/o H.No.386, B-81, Ashok Vatika, Loni Road, Pasonda Opp. Shalimar Garden, Ghaziabad, U.P.

IV.

That he shall report at least once in a week to the Police Station under which his ordinary place of residence falls, during the period of his release on parole.

V.

That he shall surrender to the Superintendent, Central Jail No.2, Tihar Jail, New Delhi on the expiry of his period of release on parole.

The petition is disposed of in the above terms. Pending application(s), if any, shall also stand disposed of.
