The present petition raises a grievance as regards unauthorized construction subsisting at fourth floor of property bearing No.13, Hathi Khana, B.G. Road, Delhi-110006.

Learned counsel for MCD, who appears on advance notice, submits that the property in question has already been booked for unauthorized construction and a demolition order has been passed on 22.04.2024. He submits that the demolition action in accordance with law shall be taken to remove the unauthorized construction in the property in question. 4.
Taking the aforesaid statement on record and binding the respondent/MCD thereto, the present petition is disposed of. 5.
Needless to say, in case there is any deficiency in the action taken by the MCD, the petitioner shall be entitled to avail appropriate remedies under law.

The concerned SHO shall provide requisite assistance to the MCD, as may be sought for the purpose of any action proposed to be taken.
