After hearing arguments for some time, learned counsel for the petitioner submits that he may be given one opportunity to move an application under Section 151 of CPC afresh seeking deposit of user charges. He states that there is a recent judicial pronouncement which permits such kind of deposit/payment in the Court.

Learned Counsel for respondent disputes to the contrary. 3.
However, at the same time he states that he would have no objection if petitioner is granted one more opportunity to move application as aforesaid before the learned Trial Court.

In view of the above, the present petition is disposed of as withdrawn and the liberty, as prayed, is granted.

It is however, clarified that this Court has not expressed any opinion about the merits of the case and all the rights and contentions of parties are reserved.
