The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 read with Article 227 of the Constitution of India seeking the following prayers:

"A. stay the operation, effect and implementation of the order dated 12.06.2026 passed by the learned Judicial Magistrate First Class, Mahila Court-01, North District, Rohini Courts, Delhi in Ct. Case No. 1374/2022 titled "Sonal Shoran v. Ashish Shoran & Ors.", particularly the direction requiring the Petitioner to hand over temporary custody of the children to the Respondent from 25.06.2026 to 30.06.2026, till the statutory appeal filed by the Petitioner under Section 29 of the DV Act is listed and considered by the competent Sessions Court;

OR The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

direct that the Petitioner's statutory appeal under Section 29 of the Protection of Women from Domestic Violence Act, 2005, filed before the District & Sessions Court, Rohini on 16.06.2026, be listed before the Ld. Vacation Judge/competent Sessions Court on an urgent and expeditious basis, preferably before 19.06.2026, for consideration in accordance with law;

B. pass such other or further order(s) as this Hon'ble Court may deem fit and proper in the facts and circumstances of the present case."

Learned counsel for the Petitioner submits that though the appeal against the impugned order lies before the Sessions Court under Section 29 of the Protection of Women from Domestic Violence Act, 2005, despite his best efforts, the said appeal could not be listed before the learned Vacation Judge during the vacation period.

In view of the plea made by learned counsel for the Petitioner, the Petitioner is directed to appear before the learned Principal District & Sessions Judge/Vacation Judge, North District, Rohini, Delhi, who shall favourably consider the request of the Petitioner for listing of his appeal under Section 29 of the Protection of Women from Domestic Violence Act, 2005 before the Vacation Judge.

The Petitioner is directed to appear before the learned Principal District & Sessions Judge/Vacation Judge, North District, Rohini Courts, Delhi on 22.06.2026.

Learned counsel for the Petitioner is further directed to serve an advance copy of the appeal upon learned counsel appearing for the Respondent.
