Present bail application has been filed under Section 439 of Cr.P.C. 2.

The petitioner was booked for committing offences under Section 186/353/324/332/506 IPC and FIR No.993/2023 was registered against him by PS Shahbad Dairy, Delhi. During the investigation, offence of Section 324 IPC was replaced with offence under Section 308 IPC. 3.

Chargesheet has already been filed. It is informed by learned counsel for the petitioner that charges have already been ascertained and the case has now been put to trial.

Learned counsel for the petitioner states that the petitioner has no previous involvement of any kind and is in custody since 19.11.2023 and that no useful purpose would be served by keeping him behind the bars. daughters are totally dependent on him. He is reportedly 32 years of age. 5.

Along with the present bail application, copy of the chargesheet has also been annexed which indicates that the Head Constable Ashok Kumar had gone to the spot on the basis of some information received from public that someone was causing harassment to a lady. When he reached there, he saw the petitioner creating commotion and when he tried to reason with him, he became aggressive. The said police official, i.e, Head Constable Ashok Kumar went towards the roof of the house to make him understand but since the door was closed, he could not do anything. It was in that process that the petitioner had allegedly thrown one piece of brick from the roof which caused injuries to Head Constable Ashok Kumar.

MLC of injured indicates that he received simple injuries only. 7.

Be that as it may, keeping in mind the overall facts and circumstances of the case, the application is allowed and the petitioner is granted bail on his furnishing personal bond and surety bond in a sum of Rs.25,000/- each, subject to the satisfaction of the learned Trial Court/learned Duty MM. 8.

Petition stands disposed of.
