This application has been filed on behalf of respondent no.2 seeking compliance of the directions passed by this Court vide order dated 15th May, 2024 qua respondent no.1.

It is the case of the applicant/respondent no.2 that despite time bound directions given in the order passed by this Court on 15th May, 2024, the Patent Office has not conducted a hearing in the case and the same remains pending.

Notice is accepted by counsel for the non-applicants, i.e. appellant and respondent no. 1.

Mr. Zubin Singh, counsel appearing on behalf of Ms. Nidhi Raman, CGSC, on instructions, submits that a new Controller has been appointed and a hearing in terms of the order passed on 15th May, 2024 shall be provided shortly.

In view of the above, the respondent no.1 is directed to give a hearing in the present case within a period of four (4) weeks from today. 6.1 Thereupon, the decision shall be rendered by the respondent no.1 within a period for four (4) weeks.
