Counsel for respondent appears and states that they are fully abiding by the undertaking given to the Court on 30th May 2011, which forms part of the record of this petition as Annexure P-3.

It has been stated in the undertaking that if there is any duty, liability, interest, penalty, or demand raised by the Customs Authorities or by the Directorate of Revenue Intelligence (DRI), the same shall be borne by respondent.

Counsel for respondent further confirms the same and states that, in fact, they have challenged the order dated 31st October 2023 passed by the Adjudicating Authority before the Writ Court in W.P.(C) 3370/2024, which is now scheduled for 12th September 2025.

Counsel for petitioner states that they are not a party in that petition and have no visibility of the matter.

Accordingly, respondent shall take steps to allow the petitioner to intervene in the matter in order that they are apprised of the proceedings. 6.
Based on the undertaking of the respondent, respondent's counsel reiterates that there is no financial implication on the petitioner since the respondent is committing himself, as per the undertaking, to suffer the penalty as may be crystallized.

Counsel for respondent states that there is no enforcement proceedings initiate yet by the Customs Authorities in this regard. 8.
The petition is disposed of, with liberty to the petitioner to revive in case of any residual issue/infraction.
