The present bail application has been filed by the Applicant under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the 'BNSS') seeking grant of anticipatory bail in FIR No. 272/2026 registered at Police Station Subhash Place under Section 75 of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as the 'BNS') and Section 10 of the Protection of Children from Sexual Offences Act, 2012 (hereinafter referred to as the 'POCSO Act'). 3.

Learned Counsel for the Applicant submits that the present FIR is only a counterblast to the FIR already got registered by the Applicant against the family members of the victim.

He further submits that the Applicant had got FIR No. 148/2026 dated 25.03.2026 registered under Sections 3(1)(r) and 3(1)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter referred to as 'SC ST Act') with respect to an incident dated 24.10.2025, whereas the present FIR No. 272/2026 under Section 75 of the BNS and Section 10 of the POCSO Act came to be registered at the instance of the victim's family on 12.05.2026.

He further submits that regarding the CCTV footage, the State has clearly mentioned in the Status Report that the area where the incident took place is not covered by CCTV footage, as the incident took place at a blind spot where there was no CCTV coverage.

Issue notice.

Learned APP accepts notice and submits that several cases have been instituted by both sides against each other.

Learned counsel appearing for the victim on advance notice submits that the victim's family had joined the investigation pursuant to the notice issued under Section 41 of the Code of Criminal Procedure, 1973 (hereinafter referred to as 'Cr.P.C') and had also requested the Investigating Agency to preserve the CCTV footage as well as the DVR. 9.

He further submits that the identity of the victim has also been disclosed by the Applicant.

Perusal of the record shows that there are various litigations pending between both the parties, i.e., the Applicant and the victim's side, and both are involved in bitter litigation, being neighbours. 11.

interim protection was granted, the Applicant had joined the investigation, but subsequently the learned ASJ dismissed the anticipatory bail application, whereupon the interim protection stood vacated. 12.

Keeping in view the facts and circumstances of the case, particularly the fact that the parties are involved in bitter litigation with each other, this Court is inclined to grant anticipatory bail to the Applicant. 13.

Accordingly, in the event of arrest, the applicant shall be released on anticipatory bail on furnishing a personal bond in the sum of Rs. 25,000/- with one surety of the like amount to the satisfaction of the concerned SHO/Investigating Officer, subject to the following conditions: i) The Applicant shall remain available on mobile numbers; shared by him with the Police.

ii) The Applicant shall not leave NCT of Delhi without prior permission of the concerned IO/SHO.

iii) The Applicant shall not directly or indirectly make an attempt to influence the witnesses or tamper with the evidence in any manner. iv) In case of change of residential address/contact details, the applicant shall promptly inform the same to the concerned I.O/SHO. 14.

Accordingly, the present application (s) is allowed. 15.

Pending applications if any also stands disposed of. 16.
